This Privacy Policy applies to the Zypexa website, the Zypexa application, and related services, features, communications, integrations, and tools, including but not limited to CRM tools, SMS messaging, email campaigns, voice calling, call tracking, call recordings, transcriptions, AI-assisted call analysis, internal messaging, tracking links, form tracking, partner tracking, reporting, billing, and account management.
By using Zypexa, you agree to the collection and use of information described in this Privacy Policy.
1. What Zypexa Does
Zypexa is a business communications, CRM, messaging, calling, email, and tracking platform. Businesses may use Zypexa to manage contacts, send messages, make calls, track campaigns, monitor activity, manage billing, and review communication history and reporting.
Zypexa is primarily intended for business and commercial use. Customers are responsible for ensuring that they have the legal right and proper consent to contact, track, message, email, call, record, or otherwise process information relating to their own contacts, leads, customers, employees, users, and campaign participants.
2. Information We Collect
We may collect the following categories of information.
Account and User Information
When you create or use an account, we may collect:
- Name
- Business name
- Email address
- Username
- Password or password authentication data
- Role, permissions, and user access settings
- Company profile information
- Business address
- Business registration information
- Tax ID or other A2P/SMS registration information where applicable
- Contact details for authorized representatives
- Login activity
- Account status
- User preferences and platform settings
Customer Business Data
Customers may upload, enter, import, generate, or receive data through Zypexa, including:
- Contacts and leads
- Names
- Email addresses
- Phone numbers
- Company names
- Addresses
- Tags, notes, custom fields, and CRM records

- Campaign records
- Dispositions

This data is generally controlled by the customer that uses Zypexa. Zypexa processes and stores this data to provide the platform.

Call recording and transcription features may be enabled or disabled depending on customer settings and service configuration. Customers are responsible for complying with call recording, consent, telemarketing, do-not-call, and related laws.
AI-Assisted Feature Data
Zypexa may use AI-assisted tools to generate call dispositions, summaries, classifications, recommendations, or similar outputs. To provide these features, call transcripts, call details, notes, messages, or related communication data may be processed by third-party AI service providers.
AI-generated outputs may be incomplete, inaccurate, or not appropriate for every use case. Customers and users are responsible for reviewing AI-generated information before relying on it.
Internal Chat and Team Messaging Data
If internal chat or messaging is enabled, we may collect and store:
- Chat thread participants
- Message content
- Message timestamps
- Read/unread status
- User IDs
- Company IDs
- Related internal communication metadata
Tracking, Cookies, Clicks, Forms, and Partner Tracking Data
Zypexa may provide tracking links, form tracking, call tracking, partner tracking, affiliate or publisher tracking, buyer routing, destination routing, conversion tracking, and reporting tools.
When these tools are used, we may collect:

Payment card information is generally processed by Stripe or another payment provider and is not intended to be stored directly by Zypexa.

4. Customer-Controlled Data
Many types of information processed through Zypexa are provided or controlled by our customers. This may include contacts, leads, messages, call records, campaign data, uploaded data, tracking data, and recipient information.
For customer-controlled data, Zypexa generally acts as a service provider, processor, or platform vendor. The customer is responsible for:
- Providing proper privacy notices
- Obtaining proper consent
- Maintaining lawful contact lists
- Complying with SMS, email, telemarketing, privacy, data protection, and call recording laws
- Responding to requests from their own contacts, leads, customers, and campaign recipients
- Ensuring their use of Zypexa is lawful
If you are a contact, lead, recipient, or end user of one of our customers, you should contact that customer directly for requests related to your information. You may also contact Zypexa at [email protected], and we may forward or coordinate your request with the applicable customer where appropriate.
5. How We Share Information
We may share information in the following ways.
With Customers and Authorized Users
We may make information available to the customer account, company admins, authorized users, and team members associated with the account.
With Service Providers
We may share information with service providers that help us operate Zypexa, such as:
- Hosting and cloud infrastructure providers
- SMS and voice providers
- Email service providers
- Payment processors
- AI service providers
- Analytics, logging, security, and monitoring providers
- Customer support and operational providers
These providers may process information only as needed to provide services to Zypexa, subject to their own terms and privacy obligations.
With Communications Providers, Carriers, and Networks
SMS, email, and voice communications may require sharing information with providers, carriers, networks, inbox providers, and related infrastructure vendors to deliver, route, process, record, transcribe, track, or report communications.
With Campaign Participants, Buyers, Publishers, Partners, and Destinations
When customers use partner tracking, call tracking, buyer routing, destination routing, conversion tracking, or similar tools, campaign information may be shared with the customer and the relevant publisher, buyer, destination, partner, service provider, or integration involved in that campaign.
With Integrations and Webhooks
Customers may configure integrations, automation webhooks, API credentials, or routing destinations. Information may be sent to those endpoints at the customer’s direction. Customers are responsible for the third-party systems they connect to Zypexa.
For Legal, Security, and Compliance Reasons
We may disclose information if we believe it is necessary to:
- Comply with law, regulation, subpoena, court order, or legal process
- Enforce our Terms or policies
- Investigate spam, fraud, abuse, security issues, or illegal activity
- Protect the rights, safety, property, or reputation of Zypexa, our customers, users, providers, carriers, or others
- Respond to provider, carrier, payment processor, or compliance inquiries
Business Transfers
If Zypexa is involved in a merger, acquisition, financing, sale of assets, reorganization, or similar transaction, information may be transferred as part of that transaction.
6. No Sale of Mobile Opt-In Information
Zypexa does not sell, rent, or share mobile phone numbers, SMS opt-in information, or SMS consent data with third parties or affiliates for their own marketing or promotional purposes.
Text messaging originator opt-in data and consent information will not be sold or shared with third parties for their marketing or promotional purposes.
This does not prevent Zypexa from sharing information with service providers, communications providers, carriers, networks, hosting providers, compliance vendors, or other parties as necessary to provide the services, deliver messages, comply with law, prevent abuse, or operate the platform.
7. SMS Privacy Notice
If you opt in to receive SMS messages from Zypexa or from a business using Zypexa, message frequency may vary. Message and data rates may apply. You may reply STOP to opt out of SMS messages and HELP for help, where supported.
Zypexa customers are responsible for providing proper opt-in language, consent disclosures, privacy notices, and opt-out instructions for their own SMS programs.
8. Cookies and Similar Technologies
Zypexa may use cookies, visitor IDs, tracking pixels, local storage, logs, and similar technologies to:
- Keep users logged in
- Secure accounts
- Remember preferences
- Track website and app usage
- Attribute clicks, leads, calls, and conversions
- Support tracking links and campaign reporting
- Improve the platform
- Prevent fraud and abuse
Some tracking features may set or use identifiers such as visitor IDs or click IDs. Customers using Zypexa tracking tools are responsible for providing any required cookie, tracking, or privacy notices on their own websites, forms, ads, and campaigns.
You can control cookies through your browser settings. Some features may not work properly if cookies are disabled.
9. Email Tracking
Emails sent through Zypexa may include tracking technologies that allow customers and Zypexa to measure opens, clicks, bounces, unsubscribes, spam reports, and related engagement. This helps provide reporting, suppression, compliance, and campaign analytics.
10. Call Recording and Transcription
Zypexa may support call recording, voicemail recording, transcription, and AI-assisted analysis where enabled. Call recording and transcription laws vary by location. Some jurisdictions require consent from all parties to a call.
Customers are responsible for determining whether call recording, voicemail recording, transcription, and AI analysis are lawful for their use case and for providing any required notices or obtaining any required consent.
11. Data Retention
We retain information for as long as reasonably necessary to provide Zypexa, operate the platform, support customers, maintain business records, comply with legal obligations, resolve disputes, enforce agreements, prevent abuse, and maintain backups.
Retention periods may vary depending on the type of data, customer settings, legal requirements, billing needs, provider requirements, security needs, and operational needs.
After an account is canceled or inactive, we may retain account data, billing records, communication records, logs, compliance records, and backups as reasonably necessary for legal, tax, billing, audit, dispute, compliance, fraud prevention, security, and business purposes.
Customers may request deletion of account data by contacting [email protected]. Deletion may be limited where retention is required or permitted by law, billing, compliance, security, backup, or legitimate business purposes.
12. Security
We use reasonable administrative, technical, and organizational measures designed to protect information. However, no system, service, or transmission method is completely secure. We cannot guarantee absolute security.
Customers and users are responsible for protecting their login credentials, limiting user access, maintaining secure devices, and promptly notifying Zypexa of suspected unauthorized access or security issues.
13. Your Privacy Rights
Depending on where you live, you may have privacy rights under applicable laws. These may include the right to:
- Confirm whether certain personal information is being processed
- Access personal information
- Correct inaccurate personal information
- Delete personal information
- Obtain a copy of personal information
- Opt out of certain processing, such as targeted advertising, sale of personal information, or certain profiling, where applicable
- Appeal certain privacy decisions, where required by law

14. California, New Hampshire, and Other State Privacy Notices
Zypexa is based in New Hampshire and may provide services to customers and users across the United States. State privacy laws may provide additional rights to residents of certain states.
We do not knowingly sell mobile opt-in consent information. We do not sell personal information in the ordinary sense of exchanging it for money. Some tracking, analytics, advertising, or campaign activities may be considered “sharing,” “targeted advertising,” or similar activity under some state privacy laws depending on how a customer uses Zypexa.
Customers are responsible for determining whether their use of Zypexa requires additional disclosures, opt-outs, consent banners, or state-specific privacy notices.
15. International Users
Zypexa is operated from the United States. If you access or use Zypexa from outside the United States, your information may be transferred to, stored in, or processed in the United States or other countries where our service providers operate.
Customers using Zypexa to contact people outside the United States are responsible for complying with all applicable international privacy, electronic communications, marketing, consent, call recording, and data protection laws.
16. Children
Zypexa is intended for business use and is not intended for children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, contact [email protected].
17. Third-Party Services
Zypexa may integrate with or rely on third-party services, including payment processors, SMS providers, voice providers, email providers, AI providers, cloud hosting providers, analytics providers, and customer-configured integrations. These third parties may have their own terms and privacy policies.
Zypexa is not responsible for the privacy practices of third-party services that are not controlled by Zypexa.
18. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we update it, we will change the effective date above. Continued use of Zypexa after an update means you accept the updated policy.
